General Terms of Use of the EnjoyBeauty+Wellbeing platform

1. Purpose of the general terms and conditions

These general terms of use (hereinafter “T&Cs”) govern access to and use of the EnjoyBeauty+Wellbeing platform (hereinafter “the Platform”). The Platform offers users various services, such as content publishing, a marketplace, digital marketing services, and access to an online community dedicated to beauty and well-being.

By accessing the Platform, you accept the T&Cs in their entirety.

2. Access to the Platform

Access to the Platform is free for users. Some features may be paid, such as purchasing products on the marketplace or accessing premium services.

The user is responsible for managing the technical resources necessary to access the Platform (internet connection, equipment, etc.).

3. Registration and user account

Some features of the Platform require the creation of a user account. During registration, the user agrees to provide accurate information and keep it up to date. The user is responsible for maintaining the confidentiality of their login credentials and must report any fraudulent use to EnjoyBeauty+Wellbeing.

4. Marketplace services

The Platform offers a marketplace where users can purchase beauty and wellness products. EnjoyBeauty+Wellbeing acts as an intermediary between sellers and buyers.

4.1 Role of EnjoyBeauty+Wellbeing

EnjoyBeauty+Wellbeing is not the seller of the products offered on the marketplace. Transactions are conducted directly between sellers and buyers, and the Platform cannot be held responsible for any disputes.

4.2 Responsibility of sellers

Sellers on the marketplace undertake to comply with all applicable legal obligations, including distance selling and consumer protection. They guarantee that the products sold correspond to their description and meet applicable quality and safety standards.

4.3 Purchase and return conditions

The purchase, delivery, warranty, and return terms of products are determined by each seller. Users should refer to the terms and conditions of the respective seller when purchasing a product.

5. Management of personal data

Users’ personal data is collected and processed in accordance with applicable regulations, including the General Data Protection Regulation (GDPR).

5.1 Purpose of data processing

The collected data is used to manage user accounts, process orders on the marketplace, facilitate interactions within the online community and for direct marketing campaigns (newsletters, personalized offers, etc.).

5.2 Sharing data

Personal data may be shared with external service providers for the technical administration of the Platform, the management of online advertising campaigns, content creation, and community management. Users can request the terms and conditions of these service providers to learn more about the processing of their data.

5.3 User rights

6. Online community “Squad”

Users can join the online community “Squad” to discuss topics such as beauty and well-being. Participation in this community is subject to the following rules:

6.1 User behavior

Users agree to be polite and not to post illegal, offensive, or inappropriate content. EnjoyBeauty+Wellbeing reserves the right to moderate or remove content that does not comply with these rules.

6.2 Publication of content

Users agree that their contributions within the community may be used by EnjoyBeauty+Wellbeing for promotional or editorial purposes, while respecting copyright.

6.3 Community management by an external service provider

Community management can be outsourced to an external service provider. Users can request the terms and conditions of this service provider to understand the community management procedures.

7. Content marketing and advertising

EnjoyBeauty+Wellbeing offers advertisers content marketing services and online advertising, including display campaigns and campaigns on platforms such as Meta (Facebook, Instagram) and Google AdWords.

7.1 Display advertising

Display campaigns are advertising services that allow banners and advertisements to be displayed on the Platform and partner websites. Advertisers are responsible for the advertising content they provide, which must comply with applicable laws (no discrimination, no misleading advertising, etc.).

7.2 Online campaigns (Meta, Google AdWords)

Online campaigns on platforms like Meta and Google AdWords are set up based on the marketing goals defined by advertisers. EnjoyBeauty+Wellbeing supports advertisers in creating and monitoring these campaigns. Advertisers can request the terms and conditions of the advertising service providers used by EnjoyBeauty+Wellbeing at any time to gain more insight into the management of their campaigns.

8. Technical maintenance and SEO

EnjoyBeauty+Wellbeing uses external service providers for the creation, technical maintenance, and search engine optimization (SEO) of the Platform. These service providers ensure the technical stability and optimization of the Platform’s visibility in search engines.

8.1 External service providers

The creation and technical maintenance of the Platform, as well as the SEO services, are provided by external service providers. Users and partners can request the terms and conditions of these service providers to understand the terms and conditions of their intervention.

9. Intellectual property

All elements of the Platform, including text, images, logos, and videos, are protected by intellectual property rights. Any unauthorized reproduction or use is strictly prohibited without the prior approval of EnjoyBeauty+Wellbeing.

10. Liability

EnjoyBeauty+Wellbeing makes every effort to ensure safe and high-quality access to the Platform, but cannot be held liable for technical failures, loss of data or inaccuracies in the published content.

The liability of external service providers responsible for content creation, technical maintenance, SEO, ad management, and community management is limited to the terms and conditions of each service provider, which are available to users upon request.

11. Amendment of the GTC

EnjoyBeauty+Wellbeing reserves the right to amend these Terms and Conditions at any time. Users will be notified of changes via the Platform and must accept the new terms to continue using the services.

12. Applicable law and jurisdiction

These Terms and Conditions are governed by Belgian law. Any dispute regarding their interpretation or implementation falls under the exclusive jurisdiction of the courts of Antwerp.
